Welcome to QuantCar.co, the online platform for browsing and reserving vehicles for sale. Please read these terms carefully before using our website. By accessing or using QuantCar.co, you agree to be bound by these terms and conditions.

1. Deposits and Vehicle Reservation

When making a deposit on our website, you acknowledge that it does not constitute the purchase of the vehicle in whole.
QuantCar reserves the right to refuse any deposit and refund for any reason, including but not limited to previous arrangements or doubts about the customer’s ability to complete the transaction.
The acceptance of a deposit by QuantCar does not guarantee the reservation of the vehicle. A confirmation by email or phone is necessary for the vehicle to be held.
If a deposit is accepted, the vehicle will be held for 5 days from the time the deposit is made, unless otherwise extended in writing by QuantCar.

2. Find Me A Vehicle

QuantCar is not obligated to find a vehicle submitted on our website. All vehicle submissions are for browsing purposes only.

3. Sell Your Vehicle

QuantCar is not obligated to purchase any vehicle submitted on our website for review. All vehicle submissions are for browsing purposes only.

4. Limitation of Liability

QuantCar.co and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services; any conduct or content of any third party on the services, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or unauthorized access, use, or alteration of your transmissions or content.

5. Modification of Terms

QuantCar reserves the right to modify these terms of service at any time. It is your responsibility to review these terms periodically for changes. Your continued use of QuantCar.co after the posting of changes constitutes acceptance of those changes.

6. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of State of Missouri, without regard to its conflict of law principles.

7. Payment Processing

QuantCar.co utilizes third-party vendors for payment processing, including credit card processors and other software. By making a payment through our website, you agree to abide by the terms and conditions of these third-party vendors.
QuantCar.co shall not be liable for any issues, errors, or disputes arising from the use of credit cards or other payment methods on our site, including but not limited to:
- Unauthorized access to or interception of your payment information.
- Errors or delays in processing payments.
- Disputes between you and the third-party payment processor.
QuantCar.co makes no representations or warranties regarding the security or reliability of third-party payment processors. Any concerns or complaints regarding payment processing should be directed to the respective third-party vendor.
In no event shall QuantCar.co be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of credit cards or other payment methods on our site, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages.
By using our website and making payments through third-party vendors, you acknowledge and agree that QuantCar.co shall not be responsible for any financial or other losses incurred as a result of such transactions.

8. Credit Applications and Form Submissions

QuantCar.co utilizes third-party software for credit applications and other form submissions. By submitting any form or application through our website, you acknowledge and agree to the following:
- QuantCar.co shall not be liable for any unauthorized access to or interception of your personal information submitted through third-party software.
- QuantCar.co makes no representations or warranties regarding the security or reliability of third-party software. Any concerns or complaints regarding the security of your personal information should be directed to the respective third-party vendor.
- In no event shall QuantCar.co be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the submission of credit applications or other forms through third-party software, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages.

Consignment Service Terms of Service

These Consignment Service Terms of Service (“Agreement”) govern your use of the consignment services provided by QuantCar, a service offered by Blakey Group Inc., located at 1829 S Kentwood Ave Suite 108, Springfield, MO 65804 (“QuantCar”). By using our consignment services, you agree to abide by these terms and conditions.

1. Consignment Process

1.1. Application and Agreement: To consign your vehicle with QuantCar, you must complete an application and sign a Consignment Agreement. This agreement outlines the terms and conditions of the consignment arrangement.

1.2. Vehicle Requirements: Your vehicle must meet certain criteria to be eligible for consignment, including a valid title (with lien release if applicable), a new Missouri Safety Inspection, and mechanical soundness.

1.3. Storage Location: Upon consignment, your vehicle will be stored at your designated location within 20 miles of QuantCar’s Springfield, Missouri location.

2. Fees and Payments

2.1. Consignment Fee: A non-refundable fee of $449 is required upfront before the consignment appointment. This fee covers administrative costs associated with the consignment process.

2.2. Commission Fee: QuantCar will receive a commission fee of 10% of the final selling price of the vehicle upon successful sale. The $449 consignment fee will be deducted from this commission fee.

3. Marketing and Sale

3.1. Marketing: QuantCar will market your vehicle on various platforms, including free and paid sites and marketplaces. We will also take appropriate photos and videos to enhance the marketing efforts.

3.2. Sale Process: Upon receiving offers for your vehicle, we will communicate with you regarding the pricing and sale process. You will have the opportunity to accept or reject offers within the agreed-upon terms.

4. Termination

4.1. Cancellation: Either party may terminate the consignment agreement within the 90-day period by providing written notice. No refund of the consignment fee will be provided upon termination.

5. Limitation of Liability

5.1. Indemnification: You agree to indemnify and hold QuantCar harmless from any claims, losses, damages, liabilities, and expenses arising out of or related to your use of our consignment services.

6. Governing Law

6.1. Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri.
